This action presents error from the district court of Osage county*-. Mary J. Barker, defendant in error, filed her petition in' that court praying a divorce from her husband, Ed Barker. The cause was submitted to a referee with authority to report findings of fact and conclusions of law, which he did, denying plaintiff’s petition. Exceptions were filed thereto, and on a hearing thereon by the district court the conclusion reached by the referee was reversed, and judgment granting plaintiff'a divorce was rendered upon, the petition and record returned.
