The administrators of the estate of Lillian Taubel have filed this petition for declaratory judgment1 to determine whether or not *447decedent was married to Joseph Sylvester Covell at the time of her death. An answer raising questions of law was filed by Mr. Covell, asking that the petition be dismissed on the ground that under section 6 of the Uniform Declaratory Judgments Act there is a specific statutory remedy available to determine the question, namely, audit of the account of the personal representatives. The matter was argued on February 26, 1960, and briefs filed.
