OPINION
COHEN, Senior District Judge:
This medical malpractice action is presently before this Court on defendant’s motion for summary judgment, pursuant to Fed.R.Civ. 56, challenging the Court’s jurisdiction over the matter.
Plaintiffs, Remy and Anne Feniello, New Jersey residents, have instituted this action against the University of Pennsylvania Hospital (HUP), a Pennsylvania nonprofit institution, for damages for personal injuries suffered by Mr. Feniello allegedly as a result of the medical malpractice of the agents and employees of HUP.
