HOLMES, Circuit Judge.
The appellant was convicted on two indictments, consolidated by consent for the purpose of trial, and sentenced on each to serve a .term of imprisonment. The first indictment, against Thomas J. Wood, Charles Smith, Clarence Hessemer, Wilbert Fabre, and Howard Fabre, charged a conspiracy between these defendants and numerous others, named and unnamed, to import alcohol into the United States from Cuba and other foreign countries, in violation of the Tariff Act of 1930 (19 U.S.C.A. § 1001 et seq.).
