MEMORANDUM OPINION

I. INTRODUCTION

On August 4, 2005, pursuant to Title 28 V.I. CODE Ann. § 411(1), (9) and Act No. 6505, the Government of the Virgin Islands, (hereinafter “the Government”), filed an action for condemnation of approximately *35821.5969 acres of land, located at Parcel No. 14 Remainder, Nos. 1, 2 and 3, Estate Smith Bay, East End Quarter, St. Thomas, Virgin Islands, a/k/a “Lindqvist Beach”, together with a check in the amount of Four Million One Hundred Eight Thousand Seven Hundred and Fifty Dollars ($4,108,750.00).
