Carrie -Garden, joined by her husband H. W. Garden, brought this suit to set aside and annul a certain judgment in a cause styled State of Texas v. Carrie Garden and Ella Nora Schauer, in which the plaintiff obtained a judgment for taxes in the sum of $23.08, and a foreclosure of a tax lien on certain lots of land in the city of San Antonio. It was further alleged that a sale was had under the judgment and the State Mortgage Company purchased the same for $230.
