OPINION

DAUGHTREY, Circuit Judge.

In this appeal, we are asked to review the district court’s order dismissing a putative class-action challenge brought under § 551 (Protection of Subscriber Privacy) of the Cable Communications Policy Act of 1984 (the Cable Act), 47 U.S.C.A. §§ 521-561 (Supp.2006). The dismissal, pursuant to Federal Rule of Civil Procedure 12(b)(6) was predicated upon the district court’s determination that the plaintiff, Jeffrey Klimas, lacked standing to contest alleged violations of the privacy provisions in § 551(b) by defendant Comcast Cable Communications, Inc.
