Appeal from an order of the Supreme Court (Bradley, J.), entered January 27, 1995 in Albany County, which, in a proceeding pursuant to CPLR article 78, granted respondents’ motion for summary judgment.

Since 1983, petitioners have owned a solid waste management facility (hereinafter the facility) in the Town of Smith-town, Suffolk County. Construction and demolition debris is collected at the facility for the purpose of disposal.
