MEMORANDUM

WOODWARD, Chief Judge.

The above case came on to be heard by the court without a jury on the 3rd and 4th days of December, 1979, with all parties and attorneys present. After hearing and considering the evidence, arguments of counsel, and the briefs and pleadings of the parties, the court files this memorandum which shall constitute the court’s findings of fact and conclusions of law to support the judgment hereinafter ordered.
