PAULSON, Justice.
This is an appeal by Oriska School District # 13 from an order of the Barnes County District Court of July 26, 1978, granting Donald Storbeck [“Storbeck”], its former superintendent of schools, a preliminary injunction to prevent the School Board of Oriska School District # 13 [“Board”] from hiring a new superintendent. The district court granted the preliminary injunction on the ground that Storbeck had not been given proper notice by the Board that his contract would not be renewed for the 1978-1979 fiscal year.
