Holdom delivered the opinion of the court.

This is an action on the case brought under the statute against appellant for negligently causing the death of appellee’s intestate, a male child of the immature age of two years. The little boy came to his death by being run over by an electrically propelled car of appellant while it was going west on 59th street near Grove avenue on June II, 1904. The original declaration, filed February 3, 1905, contained seven counts, in one of which only was contained an averment that the deceased- left a father and mother and three sisters…
