On September 29, 1888, Joseph Fish and Solomon T. Fish, co-partners as Joseph Fish & Co., brought an action of assumpsit against John V. Farwell, Charles B. Far-well, William D. Farwell, John V. Farwell, Jr., John K. Harmon and John T. Chumasero, co-partners as John V. Farwell & Co. A summons was that day issued, and on October 3,1888, it was served upon John V. Farwell, Jr., and was returned not found as to the other defendants. On December 7, 1888, a declaration was filed which contained the common counts, only, and on July 8,1889, John V.
