In the month of October, 1900, appellee, Christopher, and one John Hill Eakin, both of Nashville, Tenn., became the owners of 3,008 acres of land situated- in Muhlenberg county, Ky. It is not stated in the record what interest each owned in the land; but it has been treated by counsel-for the parties as if each owned an undivided half.
