Appellee filed his declaration with a bill of particulars attached, and defendant filed a plea of the general issue with an affidavit of merits. Subsequently the case was called for trial, but, defendant failing to appear, a jury was impaneled, and after hearing the evidence, they returned a verdict for §245.03 in favor of plaintiff, upon which judgment was rendered. At a subsequent day of the term defendant moved the court to set aside the judgment, and to have a trial of the case.
