A grand jury returned two indictments against defendant David Einis (“Einis”) alleging criminal violations of G.L.c. Ill, §142A. The indictments allege that the defendant violated regulations promulgated, pursuant to §142A, by the Massachusetts Department of Environmental Protection (“DEP”) (1) by failing to ensure compliance with procedures to prevent the release of visible or particulate asbestos emissions into the air in violation of 310 Code Mass.
