This was an action by the Fidelity Union Casualty Company against Mose Carey and others to set aside an award of the Industrial Accident Board. Tbe case was submitted'to a jury on special issues, and tbe court, on tbe answers of the jury, entered judgment for tbe defendants. Tbe plaintiff appeals.

Tbe appellant cojnplains of tbe action of tbe court in refusing to give an instructed verdict for tbe insurance company. Mose Carey was an employee of Fred Hall.
