Order affirmed, with $50 costs and disbursements to appellant against the respondent. Memorandum: We assume that the plight of the plaintiff arising out of failure of her attorney to comply with rule 115 of the Rules of Civil Practice was considered by the Special Term in the exercise of its discretion to vacate the preclusion order and permit the service of a bill of particulars. Failure to comply with the rule invariably jeopardizes the rights of the litigant and may result in the loss of such rights.
