This lawsuit concerns two competing statutory indemnity claims filed by Plaintiffs FLS Miljo, Inc. (“Miljo”) and F.L. Smidth, Inc. f/k/a Fuller Company (“FLS”) 1 and Defendant Munters Corporation (“Munters”) under Chapter 82 of the Texas Civil Practice and Remedies Code. Pursuant to an agreement between the parties, the Court decided this matter based on written submissions.
