delivered the opinion of the court:

The defendant in error, as administrator of the estate of Frederick Newman, deceased, brought this action in the superior court of Cook county' against plaintiff in error, the Aurora, Elgin and Chicago Railroad Company, to- recover damages resulting from the death of Frederick Newman, alleged to have been occasioned through the negligence of' plaintiff in error. A judgment was. rendered in the superior court for $3000, which was affirmed, upon appeal, by the Appellate Court for the First District. The cause has been brought to this…
