MEMORANDUM AND ORDER
LINDSAY, United States Magistrate Judge.
The plaintiff George Thorsen (“Thor-sen”) brought this action in February 2003 against the County of Nassau, Nassau County Civil Service Commission, and John Carway (“Carway”) alleging: (1) violation of the First Amendment and the New York State Constitution pursuant to 42 U.S.C. § 1983; (2) constructive discharge; and (3) common-law defamation.
