OPINION & ORDER
EDELSTEIN, District Judge:
Tri-Star Pictures, Inc. (“Tri-Star”) brought this declaratory judgment action to resolve a contract dispute between TriStar and Leisure Time Productions, B.V. (“Leisure Time”) involving the planned release of a motion picture entitled “Return From The River Kwai.” Tri-Star also brought a second declaratory judgment action, 88 Civ. 9129 (DNE), which seeks to establish the rights of all the parties involved in the controversy surrounding the planned release of “Return From The River Kwai.” The pending motions in both actions will be considered here.
