Plaintiffs Simon & Schuster, Inc. (“S & S”) and William J. Bennett are the publisher and editor, respectively, of The Book of Virtues and related print and audiobook publications. Defendant Dove Audio, Inc. (“Dove”) is the publisher of an audiobook, The Children’s Audiobook of Virtues. When this action was filed, Dove also intended to publish a print book, The Children’s Book of Virtues. Plaintiffs contend that Dove is liable for violation of Section 43(a) of the Lanham Act, 15 U.S.C. § 1125(a), common law trademark infringement and unfair competition,…
