VAN DEVANTER, Circuit Judge.
This was an action under a statute of Colorado by a father to recover damages of a railroad company for the death of his daughter, alleged to have been caused by *274the negligence of the company while she was a passenger upon one of its trains. At the conclusion of the plaintiff’s case in chief, the court upon the defendant’s motion, directed a verdict in its favor, and we are now called upon to consider whether or not that ruling was right.
