ORDER

BOWEN, District Judge.

Before the Court is a motion for summary judgment filed by Aetna Casualty & Surety Company (Aetna), the uninsured motorist insurance carrier in this diversity action against an unknown motorist. Aetna contends that Plaintiff James David Sanders is barred as a matter of law from recovering uninsured motorist benefits from Aetna, having recovered workers’ compensation benefits in connection with the subject vehicular accident. For the reasons stated below, Aetna’s Motion is DENIED.
