Plaintiff’s decedent, while a passenger in a motor vehicle operated by one Herman Weiss, was killed in a collision between that vehicle and the motor vehicle owned by the defendant Hauk & Schmidt, Inc., and driven by its chauffeur, the defendant Geiser.

Plaintiff’s complaint charges that the accident was due to the negligence of the above-mentioned defendants, and that the deceased was free from any contributory negligence.
