The appellee, Ellen Feeney, sued the Louisville & Nashville Railroad Company and the Chesapeake & Ohio Railway Company, jointly, for damages for the burning of her barn at Payne’s Depot, in Scott County, on December 16th, 1912. The petition alleges that the barn was set on'fire by sparks emitted from an engine belonging to one of the defendants, but that plaintiff did not know which company owned the engine that caused the fire, and that the trains of both companies used appellant’s railway track where the fire occurred.
