Appellee, as plaintiff, commenced an action against the appellant, as defendant, to recover damages for the death of her husband, resulting from injuries sustained by falling down the shaft of a mine owned and operated by the defendant, in which he was employed. The jury returned a verdict for the plaintiff. From a.judgment thereon the defendant appeals. We shall consider the errors assigned *502by the defendant in the order presented by its counsel.
