The defendant, Arthur J. Rocque, the commissioner of environmental protection, appeals1 from the judgment of the Appellate Court concluding that General Statutes § 22a-3712 affords no discretion *694to the defendant to decide whether to conduct a hearing regarding the sufficiency of the application by the plaintiff, Miller’s Pond Company, LLC, for a permit to divert water and to remove gravel under the Connecticut Water Diversion Policy Act, General Statutes § 22a-365* *3 et seq.
