SMITH, District Judge.

This matter has come on to be heard upon a motion that the cause for the ascertainment of the amount to *355be paid be placed on the jury issue docket as an action at law involving issues of fact for a jury, or, if the same is not put as a matter of procedure and right upon that docket, that an issue of fact be framed by the court for submission to a jury as to the amount of compensation which should be paid.

This proceeding is one that arises under section 10 of the Act of Congress approved August 10, 1917, entitled:
