This is an action brought to establish the paternity of a child born to Ruth Haney, an unmarried woman, on the seventh day of October, 1925.

The case was tried to a jury, and a verdict was returned finding the defendant, Grant McKay, to be the father of said child. A motion for a new trial on the ground of newly discovered evidence was denied, and the defendant appeals from the judgment and from the order denying a new trial.
