This is an appeal from the circuit court-of Harrison, county, from a judgment in the sum of seven hundred apd *754fifty dollars in favor of appellee, who was plaintiff in the trial court against the defendants, appellants here.
The plaintiff filed his original declaration, to which the defendant demurred, and the demurrer was overruled, whereupon the plaintiff filed an amended declaration and the defendant interposed the same demurrer, which was likewise overruled.
