MEMORANDUM OPINION AND ORDER

JOYCE HENS GREEN, District Judge.

Presently pending are the parties’ cross-motions for summary judgment. For the reasons explained below, the plaintiffs motion for summary judgment will be denied as to Count TV and granted in part and denied in part as to Count III; Defendant Bank of New York’s motion for summary judgment on Count IV will be granted and judgment shall be entered accordingly in favor of the Bank of New York; and the Office of Foreign Assets Control’s (“OFAC”) motion for summary judgment on Count III will be denied.
