ARCHBARD, District Judge.
This was an action in the court below for $3,065, the final payment upon a contract for the construction of a building, together with a bill of some $40 extras. The verdict was in favor of the contractors for $2,500, a material reduction, particularly if interest be counted; the jury necessarily finding, however, under the instructions of the court, that the contract was substantially, if not completely, performed.
