Appeal from a judgment of the Municipal Court of the city of New York, seventh district, borough of Manhattan, rendered in favor of the plaintiff after a trial before the court and a jury.

The action is brought to recover damages for the wrongful discharge of the plaintiff. The pleadings were oral, the allegations being simply breach of contract. *188wrongful discharge, and the answeir being “ general denial and justification of the discharge.”

The plaintiff testified that, on the 23d day of March, 1901, he observed, on reading his paper, that such was the date, and in the afternoon he went to the defendant Preger and said to him: “ My contract expires to-day, so I want to know about the future; ” to which, as he testified, the defendant Preger replied: “ Well, Mr. Jonap, we are…
