The question presented by the cross-motions for summary judgment in this case is whether the Pension Committee of a plan subject to the provisions of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. §§ 1001 et seq., violated ERISA by changing only thirty days before his retirement the valuation date of benefits paid to plaintiff.
