Background
This is a civil action arising out of Plaintiff Heather Luthy’s (“Luthy”) dismissal from the City of Attleboro’s Tax Collec tor’s Department (the “Department”), and subsequent arrest and prosecution, for alleged theft from the the Department. Defendants are David Proulx (“Proulx”), the Tax Collector for the City of Attleboro and Luthy’s former supervisor, and the City of Attleboro (the “City”). Pending before the court is the City’s Motion to Dismiss all counts against the City pursuant to Fed R. Civ. P. 12(b)(6).
