OPINION AND ORDER OF THE COURT

GIGNOUX, District Judge.

The amended complaint in this action is in two counts. The first count seeks treble damages under Section 4 of the Clayton Act, 15 U.S.C. § 15 (1964), for alleged violations of the antitrust laws arising from defendant’s patent licensing practices. The second count requests a declaratory judgment under the Federal Declaratory Judgments Act, 28 U.S.C. § 2201 (1964), that U. S. Patents Nos. 3,-093.883 and 3,166,693, relating to electrolytic capacitors, are invalid and have not been infringd by plaintiff, and that these two patents, and other…
