This was a complaint filed in equity by tbe respondent against tbe appellant in tbe district court of Boise county, in wbicb it was alleged that be and tbe appellant formed a copartnership on tbe twenty-fiftb day of June, 1867, for tbe purpose of manufacturing and selling lumber at Idaho city, under tbe firm name of Taylor & Peterson, and that from thence until tbe twenty-second day of March, 1869, they conducted their business, when tbe active operations of tbe partnership ceased.
