MEMORANDUM AND ORDER This case comes before the court on Defendant’s motion to dismiss (Doc. 5) and Plaintiff Michael Steven’s motion to amend (Doc. 16). The motions have been fully briefed and are ripe for decision. (Docs. 6, 15, 17, 21.) Defendant’s motion is GRANTED and Steven’s motion is DENIED for the reasons stated herein. I.
