The Court has before it Defendants’ Joint Defense Motion to Dismiss Due to Plaintiffs’ Failure to Plead With Particularity (docket No. 38) and Plaintiffs’ Opposition to “Joint Defense Motion to Dismiss” (docket No. 42). Plaintiffs Francisco Luis Rivera, Gloria Alcocer de Rivera and their conjugal partnership (“Plaintiffs”) filed their Complaint on October 7, 1998, alleging violations of Section 10(b) of the Securities and Exchange Act of 1934.
