GOTHARD, Judge.

This is an action for injuries sustained by plaintiffs minor fifteen year old daughter when she fell from the rear of an automobile.

James Leman, plaintiff-appellant, on behalf of his minor child, Michelle Leman, petitioned for damages against defendant-appellee, Allstate Insurance Company, the liability insurer of Henry Tolbert, owner of the vehicle involved, and Michael Tolbert, his son.
