This case arises out of a slip and fall accident at the Community Correctional Center in Orleans Parish in which the plaintiff/appellant, Michael Fournier (Fournier), was injured. Plaintiff filed suit for his injuries against the City of New Orleans *1045(City) as the owner of the Correctional Center and Charles Foti, Orleans Parish Criminal Sheriff (Sheriff) as the party responsible for the maintenance of the prison.
