MEMORANDUM AND ORDER

This matter is before the court on defendant’s amended motion to dismiss 1 the remaining cause of action by the plaintiff, John D. Callan, against defendant Pepsi- Cola Bottling Co. of Topeka, Inc. 2 Plaintiffs claim alleges a violation of the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621 et seq., contending that he was terminated from employment by the defendant due to his age.
