Defendant has been convicted after trial of criminal possession of a dangerous drug, third degree (Penal Law, former § 220.20, subd [b], par [i], heroin), criminal possession of a dangerous drug in the sixth degree (Penal Law, former § 220.05, marijuana) and criminal possession of a hypo*183dermic instrument. The third degree possession conviction must be reversed and a new trial granted at which the People must produce the informer, if he is available, or in the alternative, dismiss the first count of the indictment.
