New England Container Company, Inc. (“NECC”) brings this motion to dismiss Emhart Industries, Inc.’s claims for cost recovery and contribution under the Comprehensive Environmental Response, Compensation, and Liability Act, 42 U.S.C. § 9601 et seq. (“CERCLA”) in connection with environmental contamination that occurred at the Centredale Manor Restoration Project Superfund Site (“Centredale Site” or “Site”).
