By the Court.

This is an appeal upon questions of law and fact, from a judgment of the Common Pleas Court of Seneca county, in an action in which Adella M. Shedenhelm was plaintiff and appellant Ray C. Myers, was defendant. It is submitted to this court upon the motion of the appellee to dismiss the appeal upon questions of law and fact for the reason, as charged in the motion, that the court is without jurisdiction to entertain the appeal.
