Appeal, transferred from the Appellate Division of the Supreme Court in the First Judicial Department, from a judgment of the Supreme Court at Special Term, entered October 8, 1976 in New York County, which dismissed petitioners’ application in a proceeding pursuant to CPLR article 78.
