The appellant, a physician of the City of Allentown, was charged with having used instruments and drugs upon one Martha Mattoon, with intent to procure a miscarriage, with having produced that result, and with having those unlawful means in his possession for the purpose of causing an abortion. The lower court at the trial, quashed counts five to sixteen inclusive, and at the close of the Commonwealth’s case, count two was eliminated, and the case was submitted to the jury on counts one, three and four, upon which appellant was found guilty.
