Appeal by the defendant,, the.New York Telephone- Company, from an order -of the Appellate Term of the Supreme Court, bearing date the 30th -day of December, 1904,. and entered in the office of the clerk of the.county of New York, affirming a judgment of the Municipal Court of the city of New York in favor of the plaintiff, entered in the office of the clerk of said court on the 13th day of February, 1904, upon the verdict of a jury for fifty dollars.

The summons contained a notice that’ if the defendant failed to appear judgment would be taken against it for $500, It was returnable bn the- 8th day of January,. 1904. The pleadings' were, oral. The- plaintiff complained'for Use and occupation and demanded" judgment- for only $200. The answer was a general denial and defendant demanded a bill, of particulars."'
