This is an action brought to recover damages for personal injuries sustained by the plaintiff by means of a fall from his rvagon when driving his team along the public highway in front of defendant’s dwelling. 1. The defendant applied for a change of the place of trial from Jefferson county, where the action was pending, to some other county. The application was made solely on his affidavit that he had good reason to believe, and did believe, that he could not have a fair trial of the action on account of the prejudice of the people of Jefferson county.
